Overview

These Terms of Service outline the conditions under which Shamos Paving & Sealcoating, LLC provides estimates, scheduling, and paving/sealcoating services. By requesting an estimate, approving a quote, or scheduling work, you agree to these terms.

Estimates & Approvals

Estimates are based on the information available at the time of inspection.
Prices may be adjusted if site conditions differ from what was visible or disclosed.
Work is scheduled only after estimate approval through Jobber, email, or written confirmation.
Estimates expire after 30 days unless otherwise stated.

Scheduling & Access Requirements

You will receive a scheduled service date in advance. Advance notice varies depending on services.
Weather and material conditions may require rescheduling.
You do not need to be home during service if the work area is fully accessible and pets are secured.
Vehicles, equipment, and personal items must be moved before our arrival. Delays may result in rescheduling or additional fees.

Payment Terms

Payment is due upon completion unless otherwise stated.
Residential customers must have payment available onsite for our crew to collect on the day of service unless prior arrangements have been made.
Commercial customers may be invoiced according to pre‑approved terms.
Invoices are sent through Jobber.
Returned checks or failed payments may result in additional charges.

Billing & Payment Policies

To keep scheduling efficient and ensure timely service, the following billing policies apply:

All quoted pricing includes a 3.5% cash/check discount.
Customers choosing to pay by credit or debit card will encounter the cash/check discount being removed and 3.5% being added to the charge.
Any residential payments not available onsite as instructed may result in the work being paused or rescheduled.
Any unpaid balances may be subject to collection processes as allowed by Maine law.

Cancellations & Rescheduling

We ask that you keep the service date given to you.
Same‑day cancellations may result in a fee if our crew has already been dispatched.
Weather‑related delays are not considered cancellations.

Service Limitations & Conditions

To ensure quality and safety, the following apply:

We do not perform power washing or driveway cleaning. We encourage customers to have their driveway cleaned and/or power washed professionally if we noted moss, mold, mildew, dirt, etc. in their estimate.
Sealcoating and paving results depend on existing surface conditions.
Pre‑existing cracks, stains, structural issues, or drainage problems may affect results.
We are not responsible for damage caused by hidden utilities, unstable ground, or conditions outside our control.
Unless otherwise noted, the following exclusions apply to all paving and patch work: permits, storm drains, unsuitable soils, new gravel base, underground utilities, landscaping, pavement striping, lawn repair, night/weekend/holiday work, and traffic‑control flaggers.
Water runoff is not guaranteed if a 1% or greater grade cannot be established in the area to be paved or if existing surrounding grades prevent proper drainage.
Customers must keep vehicles off freshly sealed or paved surfaces for the recommended cure time listed in their estimate or care instructions.

Warranties

Shamos Paving & Sealcoating, LLC provides warranty coverage only for specific services and only under the conditions described below:

Sealcoating: We provide a 1‑year product quality warranty. If the sealcoating does not adhere properly, we will address that issue within the first year. Damage caused by plows, vehicles, or other external factors is not covered.
Crack Sealing: Crack sealing is not warrantied, as ground movement is unpredictable and is the primary cause of cracks returning.
Paving Work: Any concerns with paving work are evaluated case by case to determine whether the issue was within our control.
Warranty coverage varies based on the service and site conditions.

Photos & Documentation

We may take before‑and‑after photos for documentation, quality control, and insurance purposes. These may also be used for marketing unless you request otherwise in writing.

Liability

Shamos Paving & Sealcoating, LLC is not liable for:

Damage caused by pre‑existing conditions
Damage resulting from customer negligence or failure to follow care instructions
Delays caused by weather, supply shortages, or factors outside our control

Our liability is limited to the cost of the service provided.

Subcontractors

We may use qualified subcontractors when necessary. All subcontractors are required to follow our standards and policies.

Changes to Terms

We may update these Terms of Service periodically. The “Last Updated” date will reflect the most recent version.
